Terms of Service

1. Acceptance of Terms

By accessing and using the EpicBite application and website ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use the Service.

2. Description of Service

EpicBite provides cloud-based gym management software designed for fitness centers in India. The Service includes features for member management, UPI payment recording, attendance tracking, automated WhatsApp reminders, and revenue reporting. We are a software provider and do not manage your gym's physical operations.

3. Subscription and Billing

We offer our Service through three subscription tiers:

• Starter: ₹999/month (up to 50 members)
• Growth: ₹2,499/month (up to 200 members)
• Pro: ₹4,999/month (up to 500 members)

Launch Price Guarantee: The launch pricing is locked-in for the lifetime of your subscription for the first 50 gyms to sign up.

14-Day Free Trial: All accounts begin with a 14-day free trial. No credit card is required to start.

4. Cancellation Policy

You may cancel your subscription at any time without any lock-in contracts or penalty. Upon cancellation, you will retain access to the Service until the end of your currently paid billing cycle. You are encouraged to export your data via the dashboard before the cycle ends.

5. Data Ownership

We firmly believe that your gym's data belongs strictly to you. You retain all right, title, and interest in and to your member records, financial data, and other materials submitted to the Service. EpicBite claims no ownership over your data and acts purely as a processing agent.

6. Acceptable Use

You agree not to use the Service in any way that violates any applicable local, state, national, or international law or regulation. You are entirely responsible for the content of, and any harm resulting from, your data and your use of European or international SMS/WhatsApp services. Spamming or sending unsolicited marketing communications through the EpicBite WhatsApp integration is strictly prohibited.

7. Limitation of Liability

To the maximum extent permitted by applicable law, EpicBite shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues. We are not liable for any loss of use, data, goodwill, or other intangible losses resulting from your access to or inability to access the Service.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising from these Terms or the use of EpicBite shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
